How Can Workplace Bullying Be Proved?
Distinguishing ordinary disputes from sustained mistreatment and preserving evidence.
The conduct determines the legal claim
Ordinary management criticism, an isolated disagreement and persistent humiliation or threats must be distinguished. Employment duties, workplace safety, contractual breach or civil wrongs may provide different legal bases. Using the label “bullying” does not itself establish compensation.
Create a chronology
Record dates, conduct, witnesses and effects on work. Emails, messages, task changes and responses to complaints can assist. Medical evidence may support an alleged health impact but does not automatically prove the conduct or causation.
Preserve evidence lawfully
Make a written complaint and retain its outcome. Consider privacy and recording restrictions. Before resigning or stopping work, assess the consequences of termination and the available procedures and deadlines.
