What Rights Arise When Proceedings Take Too Long?
Reasonable-time criteria, documenting delay and assessing effective remedies.
Duration alone is not decisive
The assessment considers complexity, the parties’ conduct, the authorities’ conduct and what is at stake. Cases affecting children, livelihood, health or liberty may require particular expedition. A long duration does not automatically establish a violation.
Identify the reasons for delay
Prepare a chronology of hearings, adjournments, inactivity and procedural requests. Consider appropriate steps to progress the case. Responsibility should not be attributed to a party or authority without examining the record.
An international application is not automatic compensation
Jurisdiction, respondent State, victim status, effective domestic remedies and time limits need separate assessment. There is no universal route for every delay in the TRNC. Identify available compensatory or acceleration remedies and the starting point of the general four-month period.
