The Police Asked Me to Give a Statement: What Happens Next?
Witness and suspect status, legal assistance and accurate recording of a statement.
Clarify your status
Providing information as a witness differs from questioning as a suspect. Ask about the subject and legal basis of the request. A telephone invitation is not automatically an arrest, but a formal summons or order should not be ignored. Record the file details.
Consider legal assistance and defence rights
For suspects, legal assistance, protection against self-incrimination and procedural safeguards are important. Their exercise depends on status and the procedure. Do not guess answers. Raise interpretation needs and avoid destroying evidence or influencing witnesses.
Read the record before signing
Check that the statement accurately records your words and request corrections. Do not sign a blank or incomprehensible document. If detained, the reasons, court supervision and access to legal assistance need separate attention.
This publication is for general information and does not constitute legal advice on a particular matter. Legislation and case law may change. Seek legal assistance promptly, especially where a court or application deadline may apply.
