When Can a Tenant Recover the Deposit?
The purpose of a deposit, justified deductions and seeking repayment.
The deposit is not automatically forfeited
A deposit secures the obligations described in the tenancy agreement. Repayment depends on those terms, outstanding liabilities, return of possession and the property’s condition. There is no basis for assuming one universal deduction or repayment period for every tenancy.
Deductions require a basis
Unpaid rent or attributable damage must be identified and quantified. Distinguish normal use from actual damage. Inventories, dated photographs and invoices assist. Holding a deposit does not automatically authorise a tenant to withhold the final rent.
Make a written request
State the amount, payment evidence and handover date and request an itemised account. A contractual claim may be considered if disagreement remains. Check the wording of any settlement or handover document before signing.
