Who Pays for Repairs in a Rented Home?
The cause of damage, contractual duties and the risks of withholding rent.
Identify the cause first
Structural defects, ageing installations and tenant-caused damage differ. Responsibility depends on the agreement, initial condition, cause and applicable mandatory rules. The size of the repair bill alone does not decide who must pay.
Give notice and preserve evidence
Record the defect and notify the landlord in writing. Retain responses and technical evidence. Urgent steps to limit damage may be necessary, but their scope and cost should be documented. Unauthorised or unnecessary work is not automatically recoverable.
Do not assume a right to deduct rent
Unilateral deductions may create arrears and possession disputes. Seek written agreement or establish a valid legal basis for set-off. Serious health or safety issues may also justify contacting the competent public authority.
