Disagreement Between Co-owners: How Can Shared Land Be Divided?
Registered shares, occupation, partition and sale of indivisible property.
A share is not a particular room
A registered share relates to the property as a whole. It does not automatically confer separate ownership of a flat or a particular part of the land. An occupation agreement may organise use without creating a separate registered title.
Partition has legal and technical conditions
Cap. 224 requires assessment of divisibility, access, planning and registration requirements. Statutory sale procedures may apply to indivisible land. Procedures from another jurisdiction should not simply be imported into the TRNC.
Identify any occupation dispute separately
Collect title records, plans and occupation agreements. Unauthorised building, blocked access and retained rental income may raise separate claims. Check the proper sequence of Land Registry and court procedures.
